PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING NYTHERA VPN.

1. ACCEPTANCE OF TERMS

These Terms of Use ("Terms") constitute a legally binding agreement between you and Nythera VPN ("Nythera," "we," "us," or "our") governing your access to and use of the Nythera VPN mobile application and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. ELIGIBILITY

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that your use of the Service complies with all applicable laws.

3. DESCRIPTION OF SERVICE

Nythera VPN provides a virtual private network application that encrypts and routes your device's internet traffic through servers operated by us or our infrastructure partners, allowing you to select server locations and connection protocols. Features, available locations, and protocols may change over time at our discretion.

4. ACCOUNTS AND ACTIVATION

To use the Service, the App will generate and assign you an account credential. You are responsible for maintaining the confidentiality of this credential and for all activity that occurs through your account. Notify us immediately of any unauthorized use.

5. SUBSCRIPTIONS AND BILLING

5.1 Subscription Plans. The Service may be offered on a free trial, weekly, monthly, or annual subscription basis, as described in the App at the time of purchase.

5.2 Payment. Payments are processed through the Apple App Store or Google Play, as applicable, and subscription management (including entitlements) is handled via RevenueCat. All charges are billed according to the payment method associated with your Apple ID or Google Play account.

5.3 Auto-Renewal. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price.

5.4 Cancellation. You can manage or cancel your subscription at any time through your Apple ID account settings or Google Play subscriptions settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time except as required by applicable law or platform policy.

5.5 Free Trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, and your payment method will be charged automatically at the end of the trial unless you cancel beforehand.

6. ACCEPTABLE USE

You agree not to use the Service to:

We reserve the right to suspend or terminate access for any account found to be engaging in prohibited conduct, and to cooperate with law enforcement where legally required.

• Violate any applicable law, regulation, or third-party right
• Engage in fraud, hacking, distribution of malware, or unauthorized access to any system or network
• Transmit child sexual abuse material or other illegal content
• Infringe intellectual property rights
• Circumvent security measures of any service, or engage in spamming or denial-of-service attacks
• Resell, sublicense, or provide unauthorized access to the Service to third parties

7. SERVICE AVAILABILITY

We strive to provide reliable access to the Service but do not guarantee uninterrupted, error-free, or continuous availability. Server locations, protocols, and speeds may vary and are not guaranteed. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

8. INTELLECTUAL PROPERTY

The Service, including its software, design, graphics, logos, and trademarks, is owned by Nythera VPN or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, reverse-engineer, distribute, or create derivative works from the Service except as permitted by law.

9. THIRD-PARTY SERVICES

The Service relies on third-party platforms (including Apple, Google, and RevenueCat) for distribution, billing, and subscription management. Your use of those platforms is subject to their own terms and policies, which you are responsible for reviewing.

10. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, OR ERROR-FREE. WE DO NOT WARRANT THAT USE OF A VPN WILL MAKE YOU ANONYMOUS OR UNTRACEABLE, OR PREVENT ALL FORMS OF SURVEILLANCE OR DATA COLLECTION BY THIRD PARTIES.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYTHERA VPN AND ITS OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Nythera VPN and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Service.

13. TERMINATION

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service and delete your account at any time through the App's settings. Sections that by their nature should survive termination (including Sections 8, 10, 11, and 12) will survive.

14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the jurisdiction in which Nythera VPN is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your jurisdiction apply. Any disputes shall be resolved in the courts of competent jurisdiction, unless applicable law requires otherwise.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be indicated by updating the "Last Updated" date above, and, where required by law, via in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. APPLE APP STORE ADDITIONAL TERMS

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Nythera VPN only, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to furnish maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you; Apple has no other warranty obligation with respect to the Service. Apple is not responsible for addressing any claims relating to the Service or your possession/use of it, including product liability claims, legal compliance claims, or claims under consumer protection law. Apple is a third-party beneficiary of these Terms as they relate to your use of the App and has the right to enforce them.

18. GOOGLE PLAY ADDITIONAL TERMS

If you downloaded the App from Google Play, you acknowledge that your use of the App is also subject to Google Play's Terms of Service, and Google is not responsible for the Service or these Terms.
